What many organizations still don&#039;t know is that, since 2024, there has been a European law regulating how this technology can be used: the Artificial Intelligence Regulation.<\/p>\n\n\n\n<p>In this article we explain, clearly and without technical jargon, what the AI Regulation is, who it affects, how it classifies tools according to their level of risk, what dates are marked on the calendar and where it is best to start.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What you will see in this article<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What is the AI Regulation<\/li>\n\n\n\n<li>Who is affected?<\/li>\n\n\n\n<li>Risk levels<\/li>\n\n\n\n<li>Key dates on the calendar<\/li>\n\n\n\n<li>Sanctions and supervision<\/li>\n\n\n\n<li>Where to begin?<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What is the AI Regulation?<\/h2>\n\n\n\n<p>The AI Regulation\u2014also known as the RIA or AI Act\u2014is the world&#039;s first comprehensive law on artificial intelligence. It is Regulation (EU) 2024\/1689, adopted by the European Parliament and the Council.<\/p>\n\n\n\n<p>As it is a European regulation (and not a directive), it applies directly in all member states, without each country needing to transpose it into national law. That is why it entered into force on the same date throughout the EU\u2014including Spain\u2014: August 1, 2024, twenty days after its publication in the Official Journal of the European Union.<\/p>\n\n\n\n<p>Its aim is not to stifle innovation, but to establish clear rules for AI to be used safely, transparently, and with respect for human rights. Its obligations are not implemented all at once, but in stages.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who does it affect?<\/h2>\n\n\n\n<p>Virtually any company. The Regulation distinguishes two main roles:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provider: the one who develops or markets an AI system.<\/li>\n\n\n\n<li>Responsible for deployment: the person who uses that system in their activity.<\/li>\n<\/ul>\n\n\n\n<p>Most SMEs are responsible for deployment: they don&#039;t program artificial intelligence, but they use it daily through third-party tools. And that already entails its own obligations. In other words: you don&#039;t need to create AI to have responsibilities; you simply need to use it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Risk levels<\/h2>\n\n\n\n<p>The Regulation is based on a simple idea: the greater the impact an AI system can have on people, the more obligations it entails. To organize this, it classifies the tools into four levels:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unacceptable risk (prohibited): Uses that are considered a threat to people&#039;s rights, such as social scoring, behavior manipulation, or emotion recognition at work or school. These are prohibited.<\/li>\n\n\n\n<li>High risk: systems that can affect health, safety, or rights, such as those that filter resumes, grant credits, or are used in education or the justice system. They have strict obligations regarding human oversight, documentation, and data quality.<\/li>\n\n\n\n<li>Limited risk: tools such as chatbots or generative AI. The main obligation is transparency: the user must know that they are interacting with an AI or that content has been generated by it.<\/li>\n\n\n\n<li>Minimal risk: most everyday applications (writing assistants, spam filters, recommendation engines). They have no specific formal obligations.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Key dates<\/h2>\n\n\n\n<p>The Regulation&#039;s timetable is staggered. It is important not to confuse its entry into force (when the rule is already in effect) with its full application (when most obligations become enforceable):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>August 1, 2024: entry into force throughout the EU, including Spain.<\/li>\n\n\n\n<li>February 2, 2025: AI literacy bans and obligations apply (staff using AI must have minimum training).<\/li>\n\n\n\n<li>August 2, 2025: Governance rules, obligations for general purpose models (GPAI) and the sanctions regime come into effect.<\/li>\n\n\n\n<li>August 2, 2026: Full implementation of most of the Regulation, including transparency of generative AI.<\/li>\n\n\n\n<li>August 2, 2027: Obligations for high-risk systems in Annex III.<\/li>\n<\/ul>\n\n\n\n<p>A key idea: although some obligations are not yet enforceable, the Regulation is already in force and several of its parts apply from 2025.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sanctions and supervision<\/h2>\n\n\n\n<p>Non-compliance can be costly: the most serious infringements can result in fines of up to 35 million euros or 7.1% of the total annual turnover, whichever is higher.<\/p>\n\n\n\n<p>In Spain, oversight falls to the AESIA (Spanish Agency for the Supervision of Artificial Intelligence), based in A Coru\u00f1a. Spain was, in fact, the first EU country to create such an authority, and it is already operational.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where to begin?<\/h2>\n\n\n\n<p>You don&#039;t need to become a legal expert to take the first steps. Three simple actions make all the difference:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1. Take stock: note down what AI tools your company uses and what they use them for.<\/li>\n\n\n\n<li>2. Classify them by risk: check if any fit into the high risk or limited risk categories.<\/li>\n\n\n\n<li>3. Train your team: AI literacy is now mandatory. Staff using these tools must understand how they work and what their limitations are.<\/li>\n<\/ul>\n\n\n\n<p>The comparison with the GDPR is inevitable: those who prepared in advance experienced it calmly; those who left it until the end, did not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>The AI Regulation is now part of the legal framework in which European companies operate. It also affects those who only use third-party AI, is being implemented in phases, and non-compliance has real consequences. The good news is that preparing is perfectly manageable if you start systematically: knowing what you use, classifying it by risk, and training your team.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Frequently Asked Questions<\/h2>\n\n\n\n<p><strong>Does the AI Regulation affect my company even if it doesn&#039;t develop AI?<\/strong><\/p>\n\n\n\n<p>Yes. If you use third-party AI, you are &quot;deployment manager&quot; and have your own obligations, even if you didn&#039;t develop the system.<\/p>\n\n\n\n<p><strong>Since when has it been in effect?<\/strong><\/p>\n\n\n\n<p>From August 1, 2024, throughout the European Union, including Spain.
